Aavik — Terms & Conditions

1. Agreement to Terms

By accessing or using Aavik, you agree to be bound by these Terms.

2. License Grant

Aavik grants a non‑exclusive, non‑transferable, revocable license to use the software according to subscription terms.

3. Account Responsibilities

• Users are responsible for maintaining the confidentiality of their account details.
• Users are liable for all activities that occur under their accounts.

4. Subscription & Payment Terms

• Pricing is as per the selected subscription plan.
• Payments are due monthly/annually in advance. Failure to pay may result in suspension.

5. Intellectual Property Rights

• The software, logos, and trademarks remain the exclusive property of Aavik.
• No rights are granted except those explicitly stated in this agreement.

6. Data Ownership

• Users retain ownership of data input into the software.
• Aavik may process and store this data solely for providing the service.

7. Limitation of Liability

• Aavik shall not be liable for indirect or consequential damages.
• Maximum liability is limited to the subscription fee paid in the past 3 months.

8. Termination

• Either party may terminate the agreement with 30 days’ written notice.
• Upon termination, user access will be revoked, and data will be retained for 30 days before deletion.

9. Modifications

Aavik reserves the right to amend these Terms with prior notice.

10. Governing Law

These Terms are governed by the laws of Kenya, with any disputes subject to the jurisdiction of Kenyan Courts.
